I GENERAL PROVISIONS
- The http://cupkeeper.pl/ website operates under the rules set forth in these Terms and Conditions.
- The Terms and Conditions define the types and scope of services provided electronically by the http://cupkeeper.pl/ website, the rules for the provision of these services, the conditions for the conclusion and termination of agreements for the provision of services electronically, as well as the complaint procedure.
- The Terms specify the types and scope of services provided electronically by the http://cupkeeper.pl/ website, the rules for the provision of these services, the conditions for the conclusion and termination of agreements for the provision of services electronically, as well as the procedure for complaints.
- Each Service Recipient, as soon as he undertakes activities aimed at using the Electronic Services of the http://cupkeeper.pl/ Website, is obliged to comply with the provisions of these Terms and Conditions.
II DEFINITIONS
- CONTACT FORM - a form available on the Site http://cupkeeper.pl/ that allows the Service Recipient to contact the Service Provider directly.
- REGULATIONS - these terms and conditions of the Site.
- SERVICE PROVIDER - the Website Store http://cupkeeper.pl/.
- USER - a natural person, a legal person or an organizational unit without legal personality, which is granted legal capacity by law, using the Electronic Service.
- ELECTRONIC SERVICE - a service provided electronically by the Service Provider to the Customer through the Site.
- NEWSLETTER - Online service that allows the Customer to subscribe to and receive free information from the Service Provider at the e-mail address provided by the Customer.
III TYPE AND SCOPE OF ONLINE SERVICES
- The Service Provider allows through the Site the use of Online Services such as:
- use of the Contact Form,
- use of Newsletter,
- Provision of Online Services to Service Recipients is made under the terms and conditions specified in the Terms of Service.
IV TERMS AND CONDITIONS FOR THE PROVISION AND CONCLUSION OF AGREEMENTS FOR THE PROVISION OF ONLINE SERVICES
- Provision of Online Services specified in Chapter III, item. 1 of the Terms by the Service Provider is free of charge.
- The period for which the contract is concluded:
- the contract for the provision of Online Services consisting of the possibility of sending a message via the Contact Form is concluded for a definite period of time and is terminated at the time of sending the message or ceasing to send it by the Customer.
- The contract for Online Services involving the use of the Newsletter is concluded for an indefinite period of time.
- Technical requirements necessary for cooperation with the tele-information system used by the Service Provider:
- computer with access to the Internet,
- access to e-mail,
- web browser,
- inclusion of Cookies and Javascript in the web browser.
- The recipient is obliged to use the Site in a manner consistent with the law and morality, taking into account respect for personal property and intellectual property rights of third parties.
- The customer is obliged to enter data in accordance with the facts.
- The recipient is prohibited to provide content of an unlawful nature.
V. TERMS AND CONDITIONS OF TERMINATION OF THE CONTRACT FOR ONLINE SERVICES
- Termination of the agreement for the provision of Online Services:
- An agreement for the provision of Online Services of a continuous and perpetual nature (e.g. use of the Newsletter) may be terminated.
- The Customer may terminate the agreement with immediate effect and without indicating the reasons by sending an appropriate statement via e-mail to: cupkeeperpl@gmail.com.
- The Service Provider may terminate the contract for the provision of Online Services of a continuous and indefinite nature in the event that the Customer violates the Terms and Conditions, in particular, if he provides content of an unlawful nature after an ineffective prior request to cease violations with the setting of an appropriate term. The Agreement in such a case expires after 7 days from the date of submission of a statement of intent to terminate the Agreement (notice period).
- Termination leads to termination of the legal relationship with effect for the future.
- The Service Provider and the Customer may terminate the contract for Online Services at any time by mutual agreement.
VI. COMPLAINT PROCEDURE
- Complaints related to the provision of Online Services by the Service Provider:
- Complaints related to the provision of Online Services through the Site may be submitted by the Customer via e-mail to: cupkeeperpl@gmail.com with the subject line "Complaint".
- In the aforementioned e-mail message, please provide as much information and circumstances as possible about the subject of the complaint, in particular the type and date of the irregularity and contact details. The information provided will greatly facilitate and expedite consideration of the complaint by the Service Provider.
- Consideration of the complaint by the Service Provider shall take place immediately, no later than within 14 days.
- The Service Provider's response to the complaint shall be sent to the Client's e-mail address provided in the complaint notification or in any other manner provided by the Client.
VII. INTELLECTUAL PROPERTY
- All content posted on the website at http://cupkeeper.pl/ enjoys copyright protection and is the property of http://cupkeeper.pl/ The Service Recipient shall be fully liable for any damage caused to the Service Provider resulting from the use of any content of http://cupkeeper.pl/, without the consent of the Service Provider.
- Any use by anyone, without the express written consent of the Service Provider, of any of the elements comprising the content and contents of the http://cupkeeper.pl/ website constitutes an infringement of the Service Provider's copyright and will result in civil and criminal liability.
VIII. FINAL PROVISIONS
- Contracts concluded through the Site shall be concluded in accordance with Polish law.
- If any part of the Terms and Conditions is inconsistent with applicable law, the relevant provisions of Polish law shall apply in place of the challenged term.
